Focus and Scope

SAMAWA: Islamic Family Law Journal is a peer-reviewed academic journal serving as a scholarly forum for the development of Islamic Family Law studies. The journal publishes both theoretical and empirical research, aiming to contribute to classical discourse as well as contemporary developments in the field of Islamic Family Law.

The main focus of the journal covers Islamic Family Law from normative, historical, sociological, and comparative law perspectives, both in Indonesia and in other Muslim countries.

The scope of the publication includes, but is not limited to:

  1. Marriage in Islam encompasses studies on the marriage contract along with its requirements and pillars; dowry (mahar), guardians (wali), and witnesses; the law, procedures, and practice of polygamy; annulment of marriage (fasakh nikah); as well as comparative studies on marriage law across different legal systems.
  2. Divorce covers scholarly discussions on talak, including its types, procedures, and legal consequences; khulu’ (divorce initiated by the wife); fasakh (annulment of marriage); ruju’ (reconciliation after divorce) with its requirements and procedures; as well as jurisprudential analyses of divorce cases from various perspectives.
  3. Maintenance, Child Custody, and Guardianship includes studies on the husband’s obligation for maintenance (nafkah); post-divorce maintenance such as nafkah iddah, mut’ah, and child support; child custody (hadhanah) arrangements after divorce; and the guardianship of minors, covering both marriage guardians and orphan guardians.
  4. Inheritance, Will, and Gift examines the distribution of inheritance according to Islamic law; wasiat (will), including its provisions, limitations, and implementation; hibah (gift), covering its legal requirements, mechanisms, and possible annulment; as well as jurisprudential analyses of inheritance cases in various contexts.
  5. Mediation and Family Dispute Resolution in Religious Courts focuses on the processes and procedures of mediation, the role of mediators in resolving family disputes, and strategies aimed at improving the success rates of mediation within the framework of religious court proceedings.
  6. Gender Issues in Islamic Family Law addresses gender justice in family law, explores equality perspectives between men and women, and analyzes the presence and impact of gender bias in the practices and implementation of Islamic family law.
  7. Reform and Codification of Family Law in the Muslim World explores changes and reforms in family law, examines the processes and models of codification in Indonesia and other Muslim-majority countries, and analyzes the opportunities and challenges faced in implementing effective family law reforms.
  8. Comparative Studies in Family Law examines the similarities and differences among Islamic schools of law (mazhab), explores comparative perspectives on family law across various countries, and analyzes the intersections and interactions between Islamic law, customary law, and positive law in regulating family matters.
  9. Empirical Studies on the Practice of Islamic Family Law in Society involve field research on the implementation of Islamic family law, incorporating sociological, anthropological, and juridical approaches, as well as examining the influence of local customs on the practice and interpretation of family law in different communities.
