This practice not only contradicts academic moral values ​​but also raises legal issues from the perspective of Islamic Economic Law and positive law in Indonesia. In Islamic Economic Law, every economic activity must fulfill the principles of halalness, justice, and avoid elements of fraud (tadlis) and ambiguity (gharar), while Law Number 20 of 2003 concerning the National Education System emphasizes the importance of academic integrity in the educational process. This study aims to analyze the legal status of the practice of charging fees for scientific writing services from the perspective of Islamic Economic Law and Law Number 20 of 2003. This study uses a library research method with a descriptive-analytical approach. Data were obtained from primary sources in the form of the Qur'an, hadith, ijma', and qiyas, as well as secondary sources in the form of books, scientific journals, and relevant laws and regulations. The research results show that formally, this practice fulfills the elements of an ijarah contract due to the agreement, the object of the service, and the reward. However, substantially, this practice contradicts the principles of Sharia Economic Law because it contains elements of fraud, deception, and harm, making the wages obtained non-halal. From a positive legal perspective, this practice also harms academic integrity and carries the potential for administrative and criminal sanctions.</em></p> <p> </p> armawi 1 Copyright (c) 2026 AL-UMM : Progressive Research Journal https://ejournal.indafa.ac.id/index.php/al-umm/article/view/529 Mon, 16 Mar 2026 00:00:00 +0000 DETERMINASI RISIKO GAGAL BAYAR PADA PEMBIAYAAN MUSYARAKAH MUTANAQISAH DALAM INDUSTRI KEUANGAN SYARIAH https://ejournal.indafa.ac.id/index.php/al-umm/article/view/526 <p><em>Musyarakah Mutanaqisah (MMQ) financing is a Sharia-compliant financing product widely used in the asset ownership sector, particularly housing and productive businesses. However, in practice, this financing is inherently subject to default risk, which can potentially lead to disputes between Sharia financial institutions and customers. This study aims to analyze the default risk in Musyarakah Mutanaqisah financing in Cermee Village and examine its resolution from a Sharia Economics perspective. The research method used is empirical legal research with a juridical-sociological approach. The results indicate that the main factors contributing to default risk include customer income instability, a lack of understanding of the contract, and weak post-contract supervision. AL-FĪL: ANALISIS BERITA GAIB MASA LAMPAU TENTANG KEHANCURAN PASUKAN BERGAJAH https://ejournal.indafa.ac.id/index.php/al-umm/article/view/523 <p><em>I‘jāz ghaibī represents one of the dimensions of the Qur’an’s miraculous nature related to the disclosure of unseen matters beyond ordinary human knowledge. One of its primary forms is ghaib māḍī, referring to information about past events that occurred prior to the Prophetic mission and were not directly witnessed by Prophet Muhammad. Surah Al-Fīl narrates the destruction of the elephant army led by Abrahah in the event historically known as the Year of the Elephant. This article aims to analyze Surah Al-Fīl as an example of i‘jāz ghaibī within the category of ghaib māḍī through a tafsir-based and conceptual approach in Qur’anic studies. The research employs a qualitative library-based method, drawing upon classical and contemporary exegetical works. The findings indicate that the certainty of Qur’anic narration, the Prophet’s lack of historical access to the event, and the consistency of exegetical interpretations strongly support the classification of Surah Al-Fīl as an instance of ghaib māḍī. These three concepts are integrated with the local wisdom of sipakainge’, which emphasizes mutual advice and reminding one another in goodness, thereby creating the strength of togetherness and social support. On the other hand, this study highlights the role of global technology as a medium that expands access to Sufi values and opens new spaces for spiritual healing practices in the digital era. The research approach is based on observations of the surrounding community's healing experiences. The focus of the study is on the process of integrating Islamic educational values and local wisdom into the practice of sharia business management carried out by Islamic boarding schools in their economic activities. This study uses a qualitative approach with a descriptive-analytical design. Data were obtained through observation, in-depth interviews, and documentation studies of Islamic boarding school leaders, business unit managers, educators, and students. Data analysis was conducted using an interactive model through the stages of reduction, presentation, and conclusion drawing, and was validated using source and method triangulation. The results of the study show that Islamic boarding schools have generally developed business units as an effort to build economic independence as well as a means of entrepreneurial learning for students. However, the management of these businesses is still dominated by traditional patterns and does not yet fully implement the principles of sharia business management in a structured manner. The implementation of sharia principles is still limited to basic values and ethics, while the elements of planning, human resource management, and financial recording systems are not yet managed professionally.
